Governor: NCAA sanctioned Penn St. to weaken it

STATE COLLEGE, Pa. (AP) ? The NCAA overstepped its authority by imposing hefty sanctions on Penn State University in the wake of the Jerry Sandusky child molestation scandal, Pennsylvania Gov. Tom Corbett said Wednesday as he filed a federal antitrust lawsuit against the college athletics governing body.

Corbett said the university and the state have been harmed by what he called "harsh penalties" over the abuse committed by Sandusky, a former assistant football coach. The NCAA "piled on" and acted unlawfully because it stands to benefit from the sanctions, he said.

The 43-page complaint accuses the NCAA of exploiting the Sandusky case, saying its real motives are to "gain leverage in the court of public opinion, boost the reputation and power of the NCAA's president, enhance the competitive position of certain NCAA members, and weaken a fellow competitor."

The NCAA released a statement expressing disappointment with Corbett's action, calling the lawsuit meritless and an "affront" to Sandusky's victims.

At a news conference in a State College hotel, Corbett accused NCAA officials of inserting themselves into an issue over which they had no authority under their bylaws "and one that was clearly being handled by the justice system."

Corbett is asking for a permanent injunction to prevent the NCAA from imposing the sanctions, to which the university agreed in July, as well as costs and legal fees.

The Penn State Board of Trustees issued a statement noting the school was not a party to the lawsuit and played no role in preparing it.

Corbett said he waited until now to file the lawsuit because he wanted to thoroughly research the legal issues and did not want it to interfere with football season.

The university has agreed to pay a $60 million fine for child abuse prevention grants and to endure a four-year bowl game ban for the university's football program, a loss of footballs scholarships and other penalties.

When the deal was announced, Corbett ? who is a member of the university's board of trustees ? said he wanted assurance tax money would not go toward the fine, and added that part of the "corrective process is to accept the serious penalties."

When the sanctions were announced, Corbett expressed relief that Penn State had escaped the "death penalty" that would have dismantled the football program for a season or more.

The NCAA agreement has been unpopular with a significant portion of the university community, but Corbett, who is up for re-election next year, deflected a question about whether his response has helped or hurt him politically.

"We're not going to get into the politics of this," he said. An outside law firm was being retained to handle the matter, but Corbett's general counsel did not provide an estimate of cost.

"Any of the costs associated with this ... pale in comparison" with the losses people have already suffered, said Corbett's top legal adviser, James Schultz.

Corbett, a Republican, said his office did not coordinate its legal strategy with state Attorney General-elect Kathleen Kane, who is scheduled to be sworn in Jan. 15. Instead, the current attorney general, Linda Kelly, agreed to grant the governor authority to pursue the matter.

Kane, a Democrat, ran on a vow to investigate why it took state prosecutors nearly three years to charge Sandusky, an assistant under longtime football coach Joe Paterno. Corbett was the attorney general when that office took over the case in early 2009 and until he became governor in January 2011. Schultz said he would talk with Kane about the lawsuit later Wednesday.

The late football coach's family released a statement Wednesday saying they were encouraged by the lawsuit. Corbett "now realizes, as do many others, that there was an inexcusable rush to judgment" in the aftermath of the Sandusky scandal, the statement said.

State and congressional lawmakers from Pennsylvania have objected to using the NCAA's fine to finance activities in other states. Penn State has already made the first $12 million payment, and an NCAA task force is deciding how it should be spent.

Republican U.S. Rep. Charlie Dent called that "unacceptable and unsatisfactory."

Last week, state Sen. Jake Corman, a Republican whose district includes Penn State's main campus, said he plans to seek court action barring any of the first $12 million from being released to groups outside the state.

Sandusky, 68, was convicted in June on charges he sexually abused 10 boys, some on Penn State's campus. He's serving a 30- to 60-year state prison term.

Eight young men testified against him, describing a range of abuse they said went from grooming and manipulation to fondling, oral sex and anal rape when they were boys.

Sandusky has maintained his innocence, acknowledging he showered with boys but insisting he never molested them.

India rape sets off debate over women's rights

NEW DELHI (AP) ? India's army and navy canceled New Year's celebrations on Monday out of respect for a New Delhi student whose gang-rape and murder has set off an impassioned debate about what the nation needs to do to prevent such a tragedy from happening again.

Protesters and politicians have called for tougher rape laws, major police reforms and a transformation in the way the country treats its women.

"To change a society as conservative, traditional and patriarchal as ours, we will have a long haul," said Ranjana Kumari, director of the Center for Social Research. "It will take some time, but certainly there is a beginning."

The country remained in mourning Monday, two days after the 23-year-old physiotherapy student died from her internal wounds in the Singapore hospital where she had been sent for emergency treatment. Six men have been arrested and charged with murder in the Dec. 16 attack on a New Delhi bus. They face the death penalty if convicted, police said.

The army and navy canceled their New Year's celebrations, as did Sonia Gandhi, head of the ruling Congress party. Hotels and clubs across the capital also said they would forego their usual parties.

"She has become the daughter of the entire nation," said Sushma Swaraj, a leader of the opposition Bharatiya Janata Party.

Hundreds of mourners continued their daily protests near Parliament demanding swift government action.

"So much needs to be done to end the oppression of women," said Murarinath Kushwaha, a man whose two friends were on a hunger strike to draw attention to the issue.

Some commentators compared the rape victim, whose name has not been released by police, to Mohamed Bouazizi, the Tunisian street vendor whose self-immolation set off the Arab Spring. There was hope her tragedy could mark a turning point for gender rights in a country where women often refuse to leave their homes at night out of fear and where sex-selective abortions and even female infanticide have wildly skewed the gender ratio.

"It cannot be business as usual anymore," the Hindustan Times newspaper wrote in an editorial.

Politicians from across the spectrum called for a special session of Parliament to pass new laws to increase punishments for rapists ? including possible chemical castration ? and to set up fast-track courts to deal with rape cases within 90 days.

The government has proposed creating a public database of convicted rapists to shame them, and Prime Minister Manmohan Singh has set up two committees to look into what lapses led to the rape and to propose changes in the law.

The Delhi government on Monday inaugurated a new helpline ? 181 ? for women, though it wasn't working because of glitches.

Responding to complaints that police refuse to file cases of abuse or harassment brought by women, the city force has appointed an officer to meet with women's groups monthly and crack down on the problem, New Delhi Lt. Gov. Tejendra Khanna said.

"We have mandated that any time any lady visits a police station with a complaint, it has to be recorded on the spot," he said.

Kumari said the Delhi police commissioner sent her a message Monday asking her group to restart police sensitivity training that it had suspended due to lack of funds.

There have also been proposals to install a quota to ensure one-third of Delhi's police are women.

There also have been signs of a change in the public debate about crimes against women.

Other rapes suddenly have become front-page news in Indian newspapers, and politicians are being heavily criticized for any remarks considered misogynistic or unsympathetic to women.

A state legislator from Rajasthan was ridiculed Monday across TV news channels after suggesting that one way to stop rapes would be to change girls' school uniforms to pants instead of skirts.

"How can he tell us to change our clothes?" said Gureet Kaur, a student protester in the Rajasthani town of Alwar. "Why can't girls live freely?"

Some activists have accused politicians of being so cossetted in their security bubbles that they have no idea of the daily travails people are suffering.

Kumari said the country was failing in its basic responsibility to protect its citizens. But she was heartened to see so many young men at the protests along with women.

"I have never heard so many people who felt so deep down hurt," she said. "It will definitely have some impact."

Readers Write: Obamacare should keep religious exemption narrow. What has Obama done for Palestinians?

Letters to the Editor for the weekly print issue of Dec. 31, 2012: The religious exemption to Obamacare's?contraceptive mandate should remain narrow, so few groups have the right to deny employees insurance coverage for contraception. President Obama should stop support for Israel's West Bank takeover and bring US foreign policy in line with American democratic principles.

Whose liberty should be favored?

Regarding The Monitor's View of Dec. 10, "Balancing health and faith": The Obama administration's religious exemption to the contraceptive mandate in the new health-care law was appropriately crafted to give only a narrow category of groups the right to deny their employees insurance coverage for contraception.

Should our nation's laws protect individuals ? allowing them to access reproductive health-care choices according to their own conscience ? or should the law allow employers to cite their own religious views in not offering certain health-care options to their workers?

I return to the principle that drives my ministry: compassion. I have more compassion for people who want to make their own health-care decisions than I do for organizations who hinder their employees' ability to access parts of that care.

US Mideast policy should honor rights

I would like to respond to the quote from Palestinian Authority President Mahmoud Abbas featured on the Dec. 10 Overheard page and the article "Israel 'mows the lawn.'?" United Nations Ambassador Susan Rice, after the UN made Palestine a nonmember observer state, foretold that when the day's pronouncements fade, the Palestinians will find that their lives haven't changed, and their prospects for peace are diminished. But what have Ms. Rice and President Obama done to really help change Palestinians' lives and their prospects of a durable peace?

Prime Minister Benjamin Netanyahu recently declared that Israel would expand its West Bank settlements, which are illegal according to international law. Will Mr. Obama continue to provide support for Israel's West Bank takeover, and will Rice justify Israel's works in the UN? America ought to begin a national discussion about bringing our foreign policy in line with the principles in the Declaration of Independence and the Preamble to the Constitution, rather than the rule "might makes right."

10 Superstars to watch out for in 2013

Well, 2012 is in the books, and the WWE Universe rolls into 2013 with a whole lot to look forward to. The Rock will challenge for the WWE Title at the Royal Rumble, CM Punk will chase the 500-day mark (and beyond) as WWE Champion, and if Triple H is to be believed, The Undertaker will return at some point in the days ahead. But we at WWE.com like to think of the New Year as more of a time for opportunity than certainty; a chance for a Superstar on the rise to truly make his or her mark in the squared circle, and cement one?s status as the guy (or gal) to beat.

The year 2012 was no exception ? remember, this time last year Dolph Ziggler had just lost the U.S. Title, but he eventually parlayed that into a Money in the Bank contract ? and we?re sure 2013 will be a banner year for some of the Superstars who broke through into the spotlight over these past 12 months. So, coming off a wild, wacky 2012, here are 10 Superstars and Divas we think are slated to have a very lucky ?13 indeed.

NOAA lists ringed and bearded ice seal populations under the Endangered Species Act

Dec. 30, 2012 ? NOAA Fisheries announced on December 21, in compliance with a court ordered deadline, its final listing decision for four subspecies of ringed seals and two distinct population segments (DPSs) of bearded seals under the Endangered Species Act. Specifically, in line with the proposal, NOAA will list as threatened the Beringia and Okhotsk DPSs of bearded seals and the Arctic, Okhotsk, and Baltic subspecies of ringed seals. The Ladoga subspecies of ringed seals will be listed as endangered. The species that exist in U.S. waters (Arctic ringed seals and the Beringia DPS of bearded seals) are already protected under the Marine Mammal Protection Act.

This science-based listing decision will not result in any immediate restrictions on human activities; however, Federal agencies that permit or fund projects that may affect a listed species must consult with NOAA Fisheries to ensure the existence of the species is not jeopardized. In addition, this listing will have no impact on the subsistence harvest of ice seals by Alaska Natives, a practice that is central to the traditional culture and nutrition in many Alaskan Native coastal communities.

"Our scientists undertook an extensive review of the best scientific and commercial data. They concluded that a significant decrease in sea ice is probable later this century and that these changes will likely cause these seal populations to decline," said Jon Kurland, protected resources director for NOAA Fisheries' Alaska region. "We look forward to working with the State of Alaska, our Alaska Native co-management partners, and the public as we work toward designating critical habitat for these seals."

NOAA will work with local, state and Native partners, as well as the public to help determine whether to propose critical habitat designations for Arctic ringed seals and the Beringia DPS of bearded seals. This decision will happen at a later date, after compiling significant additional scientific and economic data and public input. Earlier this year, the President directed that any future designations of critical habitat carefully consider all public comments on relevant science and economic impact, including those that suggest methods for minimizing regulatory burdens. Any potential future critical habitat designation will include a full analysis of economic impact, including impact on jobs, and will strive, to the extent permitted by law, to avoid unnecessary burdens and costs on states, tribes, localities, and the private sector.

Ringed and bearded seals depend on sea ice and snow to survive. After a comprehensive review of the best available science including climate models developed by the Intergovernmental Panel on Climate Change, NOAA has concluded that sea ice and snow cover are likely to further decrease in the foreseeable future resulting in population declines that threaten the survival of these seals.

Ringed seals nurse and protect their pups in snow caves, which are threatened by late ice formation in the fall, rain-on-snow events in the late winter, earlier break-up of spring ice, as well as decreasing snow depths, which are projected to be too shallow for snow cave formation by the end of the century. Both ringed seals and bearded seals rely on sea ice for extended periods during molting, and bearded seals live on sea ice during critical months for breeding, whelping, and nursing. Sea ice is projected to shrink both in extent and duration, with bearded seals finding inadequate ice even if they move north.

NOAA Fisheries proposed the listings in December 2010 and provided opportunities for public input through public comment periods and during public hearings held in Anchorage, Barrow, and Nome. In accordance with NOAA's Policy for Peer Review in ESA Activities, the agency also solicited comments from peer reviewers on each of the proposed rules. In December 2011, NOAA administratively extended the deadline for final listing determinations six months to June 2012 to allow for additional consideration of relevant science and information. In November 2012, the Alaska district court ordered NOAA to respond to a complaint about further delay by December 21, 2012.

The Endangered Species Act defines an endangered species as "any species which is in danger of extinction throughout all or a significant portion of its range." A threatened species is "any species which is likely to become an endangered species within the foreseeable future throughout all or a significant portion of its range."

The Endangered Species Act requires species listed as endangered to receive the full protection under the Act to prevent extinction, including a prohibition against "take," which includes harassing, harming, pursuing, wounding, killing, trapping, capturing, or collecting. These protections may also be established for threatened species to prevent them from becoming endangered, but NOAA does not propose pursuing such a rule at this time.
