Egypt to replace finance and interior ministers: agency

CAIRO (Reuters) - Egypt's finance and interior ministers are to be replaced, the state news agency said on Saturday, in moves promised by Islamist President Mohamed Mursi to assuage public anger at an economic crisis.

"Middle East News Agency has learned that the new ministers will include General Mohamed Ibrahim for the Interior Ministry and ... Al-Mursi Al-Sayed Hegazy for the Finance Ministry," MENA said.

Cabinet sources confirmed the moves. They said the new finance minister has a PhD degree in economics and has researched Islamic finance, and that the new interior minister had been an assistant to the previous interior minister.

The state agency said 10 new ministers would take the oath of office on Sunday for portfolios including electricity, environment, communications and transportation.

Egypt's economy and security conditions were seriously disrupted by the political turmoil that followed the 2011 uprising against former leader Hosni Mubarak.

The country's currency has lost about 10 percent of its value against the dollar since the start of 2011 - about a third of this in the last week alone.

A senior official from the International Monetary Fund (IMF) will meet Egypt's President, Prime Minister and other top officials on Monday to discuss Cairo's request for a $4.8 billion loan, a major state-run Egyptian newspaper reported on Saturday.

A cabinet official had said the loan talks would resume after being postponed last month when 11 died and hundreds were injured in anti-Mursi protests.

You know how HP said it uncovered $5 billion worth of allegedly fraudulent revenue at Autonomy?

One thing HP has accused Autonomy of doing is?booking software-as-a-service contracts as software licensing deals.

Autonomy has denied all allegations and the Department of Justice is now investigating. While we wait for information on that, the world is trying to figure out what this alleged "fraud" is really all about.

How would the mechanics of this type of accounting work?

A former Autonomy salesperson named Virginia Briody says she's seen it happen, firsthand.

She alleges that, prior to HP's acquisition,?Autonomy executives massaged a SaaS deal into a big software licensing deal so they could recognize revenue up front, and show more growth than what the deal really was, a monthly agreement spanning four years. She says she has evidence ? emails and documents.

Equally interesting is that a day after HP accused Autonomy of cooking the books, it used the testimony of Autonomy's former vice president of finance in court to defend Autonomy's accounting practices in this deal.

Her tale is pretty interesting.

But, before we get too far into it, readers should know that Briody is?not an unbiased witness.?She's been in a legal battle with HP over compensation since April 2012. She says HP owes her nearly $200,000.

Also, representatives of both HP and of former Autonomy CEO Mike Lynch challenge much of what Briody?has to say. They deny wrongdoing with this deal and say she's upset that the most recent ruling in her legal battle with HP went against her (linked).

With those caveats in mind, let's get to Briody's story.

It all started when Briody was working as a salesperson for another software company, CA.

She had closed a four-year $1.22 million hosting/software-as-a-service deal with a customer, Pioneer Investments, and was paid her full commission, over $100,000, she says.

Autonomy bought the software unit from CA on June 9, 2010, and Briody became an employee of Autonomy and Autonomy inherited the Pioneer contract.

But there was an issue. Autonomy didn't acquire all the pieces called for in the original contract, Briody says. It didn't have a partnership with the hosting facility and it didn't gain from CA a critical piece of compliance software the customer needed, she says. Autonomy needed to find substitutions or Pioneer would cancel the contract, Briody says.

So in the fall of 2010, she signed a new deal with Pioneer and walked away with a four-year, $1.859 million contract of which Autonomy execs considered $1.8 million as new revenue, she says.

According to Briody, the new deal was the same as the old one in that the customer would not install any software and agreed to make ongoing payments (see email embedded below).

That's when things got weird, she describes.

She says Autonomy execs wanted to change the terms from a mostly hosting deal to a mostly software license deal.

Why would Autonomy execs want to do this?

Briody says a?software licensing contract would allow Autonomy to recognize most of the deal's revenue up front. The accounting, legal and finance departments created the contract, she said, and "I did not have a choice, Autonomy made me do the contract this way," she told Business Insider.

Briody knows Autonomy executives were working on a way to recognize more of the $1.9 million because she obtained emails from them and used them as evidence in her wage claim suit with the New Hampshire Department of Labor.

2) Separate monthly hosting fees

Ultimately Autonomy execs revised the contract to spell out over $1 million of software licenses sold, Briody says, showing us another email (embedded below).

To make the deal with Pioneer really look like a software deal, Briody says Autonomy even sent the customer "product code keys" which are used to unlock software. Briody says this confused the customer, since the customer wasn't installing any software. Briody showed us an email from the customer asking about the keys. (Again, representatives from HP and former Autonomy CEO Mike Lynch say that the customer asked for and bought the software.)

Eventually, Briody says she re-did the deal as her Autonomy bosses asked.

Then, she says, they fired her.

Briody?filed a wage claim with the Department of Labor in April, 2012.?The DOL found in her favor in July 2012, and said she was due $196,000 including full commission on the second Pioneer contract and damages.?In August 2012, HP, which by then owned Autonomy, appealed the ruling.?This time, the court ruled in HP's favor. Importantly, Briody's actual legal claim against HP has nothing to do with whether or not Autonomy committed fraud on this deal. Her claim is that HP, because it owns Autonomy, owes her a commission on the second deal (even though CA had already paid her a commission for the first deal) based on her employment contract with Autonomy and conversations made to her by her supervisors.

HP says that the only reason Autonomy had to redo the deal was that Briody didn't get the customer, Pioneer, the deal it wanted in the first place, and that Pioneer had to ask for it to be redone. To this, Briody says that the deal was fine until Autonomy acquired it from CA, but didn't also buy from CA all the software and services that was part of it.

At this point, it's a he-said/she-said legal mess ? with HP getting the latest result from the courts and another appeal in the works.

The whole saga is, interesting, however, in that it is a look at?how, as Briody alleges, Autonomy might have structured a SaaS deal to look more like a licensing deal primarily by

?writing a contract that denotes a large portion of the fees as a software license

?shipping the license keys even if they will not be used?

... invoicing the customer for a big chunk of money up front (much to the surprise of this customer, Briody contends)

?and structuring monthly payment terms on a single invoice (see email embedded below).

We asked HP for comment and HP politely declined. A source close to the company told us that "this transaction was not one that surfaced during the investigation" by HP into Autonomy's accounting.

A spokesperson for Autonomy's founder and former CEO Mike Lynch said that Lynch was not involved in the deal. Since this contract was over $100,000, it was reviewed by an auditor and the "revenue would have been recognized in accordance with IFRS, as applied by the auditor," the spokesperson said.

This is the same response that Lynch has made to HP's accusations.

As we previously reported, in addition to HP's accusations about hosting deals, HP has also accused Autonomy execs of improper accounting on hardware sales and in how it handled accounts related to its reseller channel.

(AP) ? Venezuelan President Hugo Chavez is being treated for "respiratory deficiency" after complications from a severe lung infection, his government said, pointing to a deepening crisis for the ailing 58-year-old president.

Chavez hasn't spoken publicly or been seen since his Dec. 11 operation in Cuba, and the latest report from his government Thursday night increased speculation that he is unlikely to be able to be sworn in for another term as scheduled in less than a week. It was the first time the government has described the lung infection as "severe," and the strongest confirmation yet that Chavez is having serious trouble breathing after days of rumors about his condition worsening.

"Chavez has faced complications as a result of a severe respiratory infection. This infection has led to respiratory deficiency that requires Commander Chavez to remain in strict compliance with his medical treatment," Information Minister Ernesto Villegas said Thursday night, reading the statement on television.

The government's characterization raised the possibility that Chavez might be breathing with the assistance of a machine. But the government did not address that question and didn't give details of the president's treatment.

Independent medical experts consulted by The Associated Press said the government's account indicated a potentially dangerous turn in Chavez's condition, but that it's unclear whether he is attached to a ventilator.

"It appears he has a very severe pneumonia that he suffered after a respiratory failure. It is not very specific," said Dr. Alejandro Rios-Ramirez, a pulmonary specialist in Puerto Vallarta, Mexico, who is not involved in Chavez's treatment. "It does imply the gravity of his pulmonary infection that led to a respiratory failure."

Dr. Gustavo Medrano, a lung specialist at the Centro Medico hospital in Caracas, said he has seen similar cases in cancer patients who have undergone surgery, and "in general it's very bad, above all after a surgery like the one they performed on him."

"I don't know the magnitude of the infection he has, how much of his lungs have been compromised, how much other organs are being affected. That's not clear," Medrano said.

"What's most likely is that he's on mechanical ventilation," Medrano added. However, he said, while respiratory deficiency means there is an abnormally low concentration of oxygen in the blood, depending on the severity it can be treated in various ways.

Dr. Michael Pishvaian, an oncologist at Georgetown University 's Lombardi Cancer Center in Washington, agreed that such respiratory infections can run the gamut from "a mild infection requiring antibiotics and supplemental oxygen to life-threatening respiratory complications."

"It could be a very ominous sign," Pishvaian said. He said it's possible Chavez could be on "life support," but added that it's impossible to be sure without more details.

The government expressed confidence in Chavez's medical team and condemned what it called a "campaign of psychological warfare" in the international media regarding the president's condition. Officials have urged Venezuelans not to heed rumors about Chavez's condition.

The statement didn't point to any particular rumors but said "this campaign aims ultimately to destabilize the Bolivarian Republic of Venezuela ... and end the Bolivarian Revolution led by Chavez."

Venezuela's opposition has demanded that the government provide more specific information about Chavez's condition.

The Venezuelan newspaper El Nacional criticized what it called an "information vacuum" in an editorial on Friday, saying Venezuelans are in the dark because "no one speaks clearly from the government." The newspaper called the situation reminiscent of secrecy that surrounded the deaths of Josef Stalin in Russia and Mao Zedong in China.

State television repeatedly played video of a song in which rappers encourage Venezuelans to pray, saying of Chavez: "You will live and triumph." A recording of a speech by Chavez appears during the song, saying: "I will be with you always!"

Chavez has undergone four cancer-related surgeries since June 2011 for an undisclosed type of pelvic cancer. He also has undergone chemotherapy and radiation treatment.

He was re-elected in October to another six-year term, and two months later announced that the cancer had come back. Chavez said before the operation that if his illness prevented him from remaining president, Vice President Nicolas Maduro should be his party's candidate to replace him in a new election.

This week, the president's elder brother Adan and National Assembly President Diosdado Cabello joined a parade of visitors who saw Chavez in Havana, and then returned to Caracas on Thursday along with Maduro.

"In the past hours, we've been accompanying President Hugo Chavez and taking him the courage and strength of the Venezuelan people," Maduro said on television Thursday. Appearing next to Cabello visiting a government-run coffee plant in Caracas, he said they had been with Chavez together with the president's brother, his son-in-law Jorge Arreaza, Oil Minister Rafael Ramirez and Attorney General Cilia Flores.

Chavez's health crisis has raised contentious questions ahead of the swearing-in set for Thursday, including whether the inauguration could legally be postponed and what will happen if Chavez can't begin his new term. The plans of Chavez's allies remain a mystery.

The Venezuelan Constitution says the presidential oath should be taken Jan. 10 before the National Assembly, and officials have raised the possibility that Chavez might not be well enough to do that, without saying what will happen if he can't.

The constitution says that if a president or president-elect dies or is declared unable to continue in office, presidential powers should be held temporarily by the president of the National Assembly, who is now Cabello. It says a new presidential vote should be held within 30 days.

Opposition leaders have argued that Chavez, who was re-elected to a six-year term in October, seems no longer fit to continue as president and have demanded that a new election be held within 30 days if he isn't in Caracas on inauguration day.

But some of Chavez's close confidants dismiss the view that the inauguration date is a hard deadline, saying Chavez could be given more time to recover from his surgery if necessary.

Some of the brewing disagreements could begin to be aired Saturday, when the National Assembly, which is controlled by a pro-Chavez majority, convenes to select legislative leaders. That session will be held just five days before the scheduled inauguration day.

With 2012 having a somewhat disappointing list of games (Diablo III, I?m looking at you), this year?s slated schedule looks to be filled with an overwhelming bevy of must-play titles. From sequels to classic titles, such as Gears of War and Grand Theft Auto, to buzzworthy releases like The Last of Us and South Park: The Stick of Truth, 2013 is shaping up to be a fun year in gaming.

It?s been a decade since the last installment in the SimCity franchise came out. Electronic Arts is rebooting the series and it looks amazing. Build specialized cities that focus on entertainment or industry and bond with neighboring metropolises. And, of course, have them destroyed by a variety of natural and extraterrestrial disasters.


South Park: The Stick of Truth
PlayStation 3, Xbox 360, PC | Release Date: Q2 at the earliest

After having conquered Broadway with ?The Book of Mormon,? Trey Parker and Matt Stone team up with Obsidian Entertainment for a foray into the world of video games. The game ventures the player into the world of ?South Park,? where they team up with the boys to retrieve the Stick of Truth. From the previews, the game will feature appearances by many of the colorful characters from show?s 16 seasons.


The Last of Us
PlayStation 3 | Release Date: May 7

Zombies are all the rage right now and The Last of Us takes a different approach at the subject. The protagonist, Joel, must travel across a post-apocalyptic United States with a girl named Ellie. Aside from battling the infected humans, the two must fight past the survivors, who are looking to cause harm to them. The game stirred up a lot of buzz when the announcement trailer was released last January.
