'Zombie' planet: Weird world may be back from the dead

Victoria Jaggard, physical sciences news editor

Is the Hubble Space Telescope a planet reanimator?

The orbiting observatory first revealed the exoplanet known as Fomalhaut b, but soon afterward astronomers pronounced the world dead, writing it off as a blob of dust. Now NASA claims to have brought Fomalhaut b back to life as a shrouded planet.

Fomalhaut is a bright, young star about 25 light years from Earth. It is surrounded by a disc of debris most likely left over from the star's formation - the perfect place to spawn planets.

In 2008 astronomers using Hubble data announced that a bright object was orbiting in a gap in the disc, a sign of a planet carving its way through the debris. The discovery was hailed as the first exoplanet portrait made in visible light.

But follow-up tests began ushering the planet toward its deathbed. No other telescopes, including Hubble's infrared cousin Spitzer, could find Fomalhaut b in images.

What's more, the original data from Hubble said that the planet varied wildly in brightness and orbited at an unexpectedly fast clip based on its position in the debris disc. This led astronomers to conclude that the bright object was no planet, just a clump of wandering dust.

Thayne Currie, an astronomer at the University of Toronto, wasn't ready for Fomalhaut b to give up the ghost. His team applied new analytic techniques to the original Hubble data and collected fresh observations from the Subaru Telescope in Hawaii. They used a similar image-processing method as the researchers who discovered Fomalhaut b to filter out the light from the star and make any planets easily visible. They also employed a more advanced technique. Neither filtering method showed brightness variations for the object.

"Honestly it is unclear to us exactly how the original authors ... got that result in the first place," Currie said in an email to New Scientist. The new data also show the object moving at just the right speed for it to be a planet.

The team thinks the best explanation is that Fomalhaut b is a planet a bit more massive than Jupiter that's engulfed in a cloud of dust. "It could be shrouded in dust because the planet is still surrounded by a swarm of small, boulder- to asteroid-sized planetesimals that are colliding and thus making dusty debris," Currie said. The dust would explain why the planet continues to be undetectable with current infrared telescopes. It's also possible the colliding bodies are moons in the making, he added.

Their work may not be the nail in the coffin, though, as researchers need more data to back up Fomalhaut b's revived planethood. And if the new model is correct, Fomalhaut b just lost one of its biggest claims to fame: the light from the object would be coming from the shroud of dust rather than the planet itself, which would mean it's no longer among the handful of worlds that have had their picture taken.

Belkin Chef Stand + Stylus

By Eugene Kim

As we all learned from Disney's Ratatouille, anyone can cook?even this hapless author? with the help of the Internet. Smartphones and tablets make every recipe imaginable just a tap away, but if you're in the kitchen, it's more like a dirty and dangerous tap away for your delicate electronic device. Enter the Belkin Chef Stand + Stylus ($39.99 list), a sturdy stand that keeps your tablet safe from food splatters, with an oversized stylus that makes it easy to interact with your virtual recipes.

The matte black rubber and chrome highlights give the Belkin Chef Stand + Stylus a clean look that should blend nicely with most modern kitchens. The circular base has a sloped top, with a lip that juts out from the front. The stand is made for Apple iPads, but really it works with any tablet that is less than a half an inch thick. There are two orientations for use, either horizontal on the sloped top of the stand or propped upright in the lip. The oversized stylus features a grippy rubber body with a thick metal end, making for a comfortable balance in your hand. Belkin also includes a small rubber puck to hold the stylus when not in use.

The stand is nice and sturdy, with the non-slip rubber accents helping to keep both your tablet and the stand in place. The stylus, while comfortably balanced, requires considerable pressure to register touches. Slow or light touches often didn't register in my tests, but once I got accustomed to the amount of pressure required, this became less of an issue. The capacitive tip is also magnetized, meaning you'll be able to wake the iPad 2 ?or New iPad ?from sleep by simply gliding the stylus along the bezel. Both the stand and stylus are washable, which is perfect for sloppy chefs like me. The two parts keep your tablet safe when cooking by raising it off of food covered countertops and making sure you never have to touch the screen with food covered fingers.

It might not be the best stand or stylus, but for only $40 the Belkin Chef Stand + Stylus is a pretty good deal. Both parts are well made and do exactly what they set out to do?make it easy and safe to use your iPad or other tablet in your kitchen. I would have liked to see a companion app, but given the abundance of capable cooking apps out there, it's not really an issue. If you spend a lot of time in the kitchen and your iPad is your primary recipe book, then this is definitely one accessory worth checking out.?

SITTWE, Myanmar (AP) ? Myanmar authorities on Friday revised downward the death toll from this week's ethnic violence in the country's west after warning that the strife risks harming the country's reputation as it seeks to shift to democratic rule.

State television reported Friday night that 67 people had died, 95 were injured and 2,818 houses burned down from Sunday through Thursday in seven townships of Rakhine state.

Rakhine state spokesman Win Myaing told reporters shortly before the broadcast that the previous count he had given of 112 dead in violence involving the Buddhist Rakhine and the Muslim Rohingya communities was based on a mistaken tally of figures received by his office. His revised figures of 64 dead and 68 wounded was slightly lower than that given by state television.

"Many of those who were killed as a result of clashes between the two sides, and at least two died of gunshot injuries," Win Myaing said. There has been no breakdown by ethnic group of the casualties. Some Rakhine residents in affected areas have told The Associated Press they were shot at by government soldiers trying to keep order.

The mob violence has seen entire villages torched and has drawn calls worldwide for government intervention.

In June, ethnic violence in the state left at least 90 people dead and destroyed more than 3,000 homes. About 75,000 have been living in refugee camps ever since.

Curfews have been in place in some areas since June, and been extended to others due to the recent violence.

Tensions still simmer in part because the government has failed to find any long-term solution to the crisis other than segregating the two communities in some areas.

Thein Sein's government has described the problem as an obstacle to development on other fronts. He took office as an elected president last year, and has instituted economic and political liberalization after almost half a century of repressive military rule.

"As the international community is closely watching Myanmar's democratic transition, such unrest could tarnish the image of the country," said a statement from the office of President Thein Sein published Friday in the state-run Myanma Ahlin newspaper.

Although Win Myaing said earlier that the situation was quiet Friday, a resident of Ramree township, which had been spared in the recent wave of unrest, said there were clashes there Friday morning.

"Residents are very fearful of imminent attacks by the Muslim community because security presence is very little. We don't feel safe. We want the Bengalis to be moved away from the Rakhine community," Kyaw Win, 30, said. Rakhine prefer to use the term Bengali for Rohingya, whom they contend are not a distinct ethnic group.

Kyaw Win said that a few houses had been burned down but that no casualties were reported.

"The army, police and authorities in cooperation with local people will try to restore peace and stability and will take legal action against any individual or organization that is trying to instigate the unrest," the presidential statement published Friday warned.

The long-brewing conflict is rooted in a dispute over the Muslim residents' origin. Although many Rohingya have lived in Myanmar for generations, they are widely denigrated as intruders who came from neighboring Bangladesh to steal scarce land.

The U.N. estimates their population in Myanmar at 800,000. But the government does not count them as one of the country's 135 ethnic groups, and so ? like neighboring Bangladesh ? denies them citizenship. Human rights groups say racism also plays a role: Many Rohingya, who speak a Bengali dialect and resemble Muslim Bangladeshis, have darker skin and are heavily discriminated against.

A statement issued Thursday by the office of U.N. Secretary General Ban Ki-moon called on Myanmar authorities "to take urgent and effective action to bring under control all cases of lawlessness."

"The vigilante attacks, targeted threats and extremist rhetoric must be stopped," Ban said. "If this is not done, the fabric of social order could be irreparably damaged and the reform and opening up process being currently pursued by the government is likely to be jeopardized."

In Washington, State Department spokeswoman Victoria Nuland said the U.S. was deeply concerned about the reports and urged restraint.

Casualties from several townships were taken were taken to a hospital in Sittwe, the state capital not yet hit by the latest round of violence. There, Aung Moe Khaing, 25, told The Associated Press he was shot Tuesday when soldiers dispersed the crowd. He was wounded in an arm and a leg.

Phyu Thein Maung, 39, from Yathetaung township, said he was shot in the buttocks.

"Muslims provoked us from inside their village and challenged us from their community, guarded by soldiers," he said. "People were very angry as they shot iron spikes at us with catapults and made abusive gestures. I was hit by a gunshot when soldiers dispersed the crowd."

There have been concerns in the past that soldiers were failing to protect the Rohingya community, but accounts this time from Rakhine villagers suggest that Myanmar's military may have been defending the Rohingya.

The crisis has proven a major challenge to Thein Sein's government and to opposition leader and Nobel Peace laureate Aung San Suu Kyi, who has been criticized by some outsiders as failing to speak out strongly against what they see as repression of the Rohingya.

The U.N. warned Thursday that the crisis had sent a new wave of refugees to seek shelter in camps already overcrowded with 75,000 people from the June violence.

Bangladesh has put its border guards on alert, fearing a new influx of Rohingya refugees.

On Thursday, Bangladesh border guards turned away 45 Rohingya trying to enter into Bangladesh by boats, said Lt. Col. Khalequzzaman, a border commander.

Local police chief Selim Mohammad Jahangir said Friday that at least another 3,000 Rohingya Muslims had been spotted on about 40 boats on the Naaf River off Bangladesh's Tekhnaf coast.

Bangladesh says it's too poor to accept more refugees and feed them. Bangladesh is hosting about 30,000 Rohingya who fled Myanmar to escape government atrocities in 1991.

He's Baaaaaack! Arrington Returns To TechCrunch - Business Insider

Michael Arrington is writing for TechCrunch again.

A year ago, he was booted from AOL because then media boss Arianna Huffington didn't like how he was an investor in startups, writing about startups.

But now Huffington is no longer the boss of all AOL media. She's over in the Huffington Post corner (a very big corner).

The current boss of AOL's tech media brands doesn't care as much.

MG Siegler, Arrington's partner at a VC firm called Uncrunched, is also going to be writing more for TechCrunch again (though he never actually stopped).

Arrington's explanation:

Last year I was?fired?and?began writing on Uncrunched.

Today?AOL unfired me.

I am a venture capitalist and have all sorts of conflicts of interest. Many of you think that conflicts of interest are inherently bad and people with them shouldn?t be writing stuff for other people to read. A lot of people would agree with you. It was the reason AOL fired me last year, after they invested in my venture fund CrunchFund.

I disagree.

AOL now also disagrees.

Before everyone starts?freaking the [redacted] out, just hold on a second and hear me out.

First of all, it?s not like I?m back running the place. AOL already put the kibosh on one post I was going to write, something that never happened in the old days. They had a good reason, they wanted to wait until things were properly announced. So I just?wrote about it?on Uncrunched instead.

Arrington's boss, Jay Kirsch (with a K) also explains:

Are they conflicted? Yeah, of course they are, and we will be transparent on that issue at all times. But, we also believe our readers are smart enough to put these columns into context and understand the impact of CrunchFund?s investing on the editorial.

As consumers of tech news, we're glad Arrington and Siegler are going to be writing more.

As producers of tech news, we need to stop writing this post and get back to work now.

Best Buy offers exclusive Windows 8 deals, demos

(AP) ? Confused by Windows 8? Best Buy hopes it can help.

The consumer-electronics retailer is hoping to capitalize on the launch of Windows 8. It's trying to lure customers with exclusive computers and staffers trained to explain and demonstrate the new operating system from Microsoft Corp.

Windows 8 has a new look that's intended to create a seamless experience for users, whether they're on PCs, tablets or smartphones. Featuring a colorful array of tiles that fill the screen instead of the familiar start menu and icons, it's designed especially for touch-sensitive screens. Windows 8 will come pre-installed on almost all new PCs.

Best Buy Co. spent three years coming up with a plan for the launch. That includes two years of developing 45 exclusive Windows 8 computers and laptops designed with manufacturers such as Hewlett-Packard Co. to AsusTek Computer Inc. Nearly half of those computers feature touch screens. (Best Buy will also carry a wide range of non-exclusive Windows products, including tablets and smartphones.)

Microsoft's radical remake of Windows arrives at a time when Best Buy is struggling to avoid the fate of Circuit City, which liquidated in 2009. The company hopes the new Windows will spur sales as it faces tough competition from online retailers and discounters. Consumers' tastes are shifting to tablets and smartphones and, at the same time, they increasingly use Best Buy stores to browse for electronics before they buy the items online at lower prices, a practice known as showrooming.

Best Buy, which is based in Minneapolis, hasn't reported an increase in net income for two years.

Exclusive products are one way traditional brick-and-mortar stores are battling showrooming.

Another is customer service. To that end, Best Buy spent 50,000 hours training its staff members to show customers the ins and outs of Windows 8, as it's very different from its predecessors. Windows 8 is the biggest Windows revamp since Windows 95.

In addition, its Geek Squad technical service staff created 12 two-minute tutorials available online, each explaining a different feature of Windows 8.

"The demo experience becomes very, very important because of newness of touch feature," said Jason Bonfig, vice president for computing at Best Buy.

Morningstar analyst R.J. Hottovy's expectations are muted in terms of how much Best Buy will benefit from the launch. He believes Windows 8 "might give a temporary lift to sales, but longer term it doesn't solve any of the real issues facing the company," he said.

Barclays analyst Alan Rifkin crunched numbers on past Windows launches and found they did not provide a significant boost to retailers.

"While our research reveals that personal computer demand has been uniformly weak in the two to three quarters preceding a Windows release, historical Windows releases have not been identified as significant drivers of improved performance once the launch has taken place," he wrote in a note on Thursday.

Best Buy sounded more positive. The retailer started taking advance orders for Windows 8 devices and demo-ing the product on Sunday, and so far the response has been positive, Bonfig said.

"We've been very happy with interest and traffic in stores," he said.

Great Ideas And Suggestions On Commercial Real Estate | Eric - First

You can sometimes become overwhelmed when thinking and dealing with commercial real estate, yet you don?t have to be discouraged for too much longer. This article will give you some great advice to make your commercial property dealings proceed more smoothly.

Get yourself set up online before you buy any property. Start by having a website designed, and create a LinkedIn profile. Get your site seen by investing in search engine optimization services. The idea is for people to learn about you by just entering your name into a search field.

Retain an attorney who is experienced in commercial real estate law before you purchase your first property. It is best to always be protected by a trustworthy, knowledgeable legal professional who can help you to resolve any issues that may arise.

TIP! Know that the size of a property is important when you?re looking for a spot for a business that?s permanent. If you don?t invest in commercial property that allows for growth, your business is going to be hunting for a new home again within a few short years.

Properties, like people, have finite life spans. It?s important to be aware of this. Don?t make the mistake of overlooking the fact that you will need to put a substantial amount of money into the property to keep it well-maintained. Consider the fact that a property could need a brand new, expensive roof fitted, or a modern electrical system installed. All buildings eventually need maintenance to maintain the quality of your investment. Be prepared for when these necessities come up.

Pro Forma

This makes it easier to determine if the terms are consistent with the property?s rent roll and pro forma financial disclosures. If you don?t read over these terms, you may find something that?s not the rent roll and it could change your pro forma.

TIP! Keep your center of attention on one investment property at a time. Regardless of whether your real estate investment is a office, apartment complex, or undeveloped commercial land, it is important to concentrate your efforts on only one investment.

You can find different kinds of brokers. For example, full-service brokers represent both the landlord and tenants. There are also tenant brokers that work exclusively for the tenants. You reap better benefits if you hire an experienced tenant broker because the broker will ensure that you receive the best deal possible.

Look around at the general environment around the building. The one who?ll have to clean up any environmental waste on your property is you. Is your property located in an area known for floods? Make sure you think it over! Talk to an environmental assessment agency to learn more about the area where the property is located.

Thoroughly tour every potential property. Think about asking a contractor to assist you in evaluating each of the properties, since they will likely see things that you may miss. After touring, feel free to begin negotiations or even make your preliminary proposal. Make sure you evaluate any counteroffers well enough before you make any purchasing decisions.

TIP! Make sure you consider any possible environmental problems. One major problem is when your property has hazardous waste material issues.

The neighborhood where the property is located is very important. You want to try to purchase commercial property in a neighborhood that is affluent so that you know your clientele are a little bit more well off and can spend more. Or, if you are offering a service particularly attractive to the less wealthy, you should purchase in a less well-to-do area.

Before negotiating a lease with a commercial tenant, work on narrowing down the list of things that would constitute default. Doing so makes it less likely that a tenant can default on the lease. This type of situation is considered very undesirable.

Square Footage

TIP! When choosing brokers with whom to work, find out the amount of experience they have dealing with commercial properties. Make sure they are specializing in the desired area that you?re selling or buying in.

One thing you should be clear about when purchasing or selling property is the amount of square footage that exists. Commercial real estate may be measured by its usable square footage, which is where business would occur. Other measurements could involve uninhabitable spaces and walls. Therefore, it is very important to know both types of square footage.

Write down your goals before you start to search out the perfect commercial property. Do you plan on having your own business on the property or do you plan on leasing it? Have some clear goals before you look for commercial property, it will save you time and a lot of work.

Prior to selling commercial property, have it inspected first by a professional. If they do find anything amiss, get it fixed immediately.

TIP! If you are renting or leasing, be sure to know about pest control arrangements. This is especially important when an area is known to have pest and rodent problems.

Keep your focus on the largest issues when writing your letters of intent. Keep it simple and save the smaller issues for later in the negations. The negotiations will go much better and be less stressful if you keep the small stuff out of the way and can focus on the larger issues first.

You have to purchase a real estate appraisal yourself before you can qualify for a commercial loan. You?re not going to be allowed to use this later by the bank. Protect yourself from this problem and get the appraisal done on your own dime.

Commercial properties can be difficult to find, regardless of how experienced you are. The advice in this article should help make the process of buying commercial property proceed more smoothly.

TIP! Keep watch for sellers who are looking to get rid of their properties quickly. You want to make sure you find the ones that are highly motivated, especially any who are very eager to make money by selling below market value.

If You Want to be "Right," Be Willing to Change Your Mind a Lot

If You Want to be "Right," Be Willing to Change Your Mind a LotNobody ever wants to hold onto the "wrong" point of view for an extended period of time. But, speaking with 37 Signals, Amazon CEO Jeff Bezos points out that the only way you can be "right" most of the time is if you're willing to change your mind a lot.

It sounds simple enough, but ideas are often so ingrained in our heads that it's easy to get lost in your own opinions. During a Q&A session at 37 Signals, Bezos shares this insight:

He said people who were right a lot of the time were people who often changed their minds. He doesn't think consistency of thought is a particularly positive trait. It's perfectly healthy?encouraged, even?to have an idea tomorrow that contradicted your idea today.

The idea is that you should consider your point of view as temporary. It's always changing, and if you come to a point where you want to go back and re-evaluate an idea, that's not a bad thing. We're all wrong a lot of the time, and backtracking on an opinion shows that you're open to new ideas that challenge the way you view the world. After all, remember that, "only imbeciles never change their minds."

WNBA Championship Parade Almost Happens

WNBA Championship Parade Almost HappensWe hoped to recapture the magic of the single greatest headline/photo combination in Deadspin history, but the weather did not cooperate. Literally scores of fans were set to line the streets of downtown Indianapolis to f?te their triumphant Fever, who prevailed in the best-of-5 WNBA finals this weekend, or maybe even late last week. But it rained, and the celebration had to be moved inside the Bankers Life Fieldhouse. Well, not the actual arena. The entry pavilion of the arena. A good time was had by all!

Thankfully, this led to some spectacular photos from WISH-TV:

The street where the parade would have been held.

Actual caption: "This float would have been seen if the parade for the Fever wasn't canceled."

Meanwhile, on Monday night, a 43-year-old Indianapolis woman was arrested on charges of public intoxication and resisting law enforcement.

"Baby, I'm celebrating the Fever winning the championship," the fan told police, according to the report. "I'm loaded. I ain't gonna lie."

App lets strangers weigh in on why relationships... | Stuff.co.nz

Confused about why a relationship went wrong or the true meaning of a text message? A new web app that relies on the comments of strangers may provide some clarity.

The app, called Impressions, was recently launched on the website Wotwentwrong, which lets users anonymously get feedback from their exes.

With Impressions people can create a timeline of their relationships and mark milestones, such as their first date or kiss, and embed polls to get feedback and advice on everything from the significance of a text to dealing with arguments.

"It's not the sanitized content you get from the magazines or all the online blogs that give you the 'top ten reasons why this happened' or 'five ways to do that'. It's real situations and advice," said Audrey Melnik, the founder of San Francisco-based start-up Wotwentwrong.

"You're doing all of this anonymously so you can really expel those feelings of anxiety."

Melnik said the app was created to help relieve the uncertainty and anxiety that relationships can produce by providing advice on how to proceed in situations that may cause confusion.

"It's also about self-improvement," said Melnik, adding that while many people focus on improving their professional habits, they often ignore their personal relationships.

"People are going on all these online dates, meeting people and dating them, and they're failing for various reasons," she explained. "They're not aware about what they might be doing wrong, and gaining any new skills in how to be better in dating."

Although some critics might argue that divulging details about a relationship online may verge on the obsessive, Melnik argues that it is no different than what happens in daily life.

"Who doesn't obsess about their relationships?" she said. "All we're doing is taking what is already happening offline and presenting it online," she explained.

Another web app launched recently called, HeTexted, also taps into crowdsourcing, the collective knowledge of a group of people. It helps women decipher the meaning of puzzling text messages.

Melnik believes one of the main sources of anxiety in relationships is the lack of communication and cites the text message as the prime source of ambiguity.

"We're not hearing tone, so we lose a lot of actual data," she said. "If you want to have a conversation, you should use something that's more conducive to a two-way conversation - like a phone."

KDDI unveils HTC J Butterfly (HTL21), the first phone with 5-inch 1080p display

KDDI unveils HTC J butterfly HTL21, the first phone with 5inch 1080p display

We've been hearing about a certain 5-inch HTC phablet for Verizon since July, but it looks like its Japanese counterpart may actually hit the market first. Unveiled by KDDI as the HTC J Butterfly (HTL21), this Android 4.1 device is the first announced phone to feature a 5-inch, 440ppi full-HD "Super LCD 3" panel, and it's fittingly complemented by a 1.5GHz quad-core APQ8064 underneath, making this the latest member in the small family of Snapdragon S4 Pro phones. There's an eight-megapixel camera that naturally handles 1080p video at the back, accompanied by a 2.1-megapixel front-facing imager. Other details include 2GB RAM, 16GB internal storage, microSDHC expansion, 802.11a/b/g/n WiFi, Bluetooth 4.0 (LE), NFC, LTE and CDMA/GSM/UMTS/GPRS radios -- that's right, it's a global device. Not bad for a 140g package, and it's waterproof as well, rated at IPX5. But the question is how well will the 2,020mAh battery last under that super dense LCD and high-end processor? Only time will tell -- even KDDI has yet to finalize this part of the specs. Folks on the KDDI network can grab hold of this powerful phone in early December, with a choice of red, white or black.

Stock market edges up on stronger housing report

The stock market ended mostly higher Tuesday after a surprisingly strong housing report.?Better results from Mattel, Goldman Sachs, and Johnson & Johnson also shot the?stock?market higher.

A surprisingly strong housing report helped push the?stock?market mostly higher Wednesday, while weak earnings reports from Intel and IBM weighed on the Dow Jones industrial average.

Even though the two tech giants disappointed, overall earnings results have come in much better than some investors had feared, said Dan Veru, chief investment officer at Palisade Capital Management in Fort Lee, New Jersey.

"Everyone is breathing a sigh of relief that things aren't all that bad," Veru said. "That's what you see happening now."

The Dow edged up 5.22 points to close at 13,557, barely managing its fourth straight day of gains. The broader Standard & Poor's 500 index gained 5.99 points to 1,460.91.

Better results from Mattel, Goldman Sachs, and Johnson & Johnson shot the?stock?market higher Tuesday. For the week, the Dow is up 1.7 percent and the S&P 500 is up 2.3 percent.

Heading into this earnings season, FedEx, Caterpillar and other global heavyweights had warned investors that China's slowing economy and Europe's ongoing debt crisis would weigh on quarterly profits.

Analysts still expect that third-quarter earnings for companies in the S&P 500 will shrink for the first time since 2009.

IBM reported sales late Tuesday that missed Wall Street's expectations. On a call with analysts, IBM's chief financial officer said the company faced "more challenging" market conditions in September, the final month of the quarter, as cautious customers and a weakening euro undercut its results. IBM's?stock?sank $10.37 to $200.63.

Without IBM's drop, the Dow would have been 79 points higher.?Stocks?with higher prices carry more weight in the average of 30 large companies. Every move of $1 in any Dow?stock?is equivalent to moving the Dow average 7.68 points.

Intel warned that sales of personal computers will likely remain weak during the holiday season this year. The chip-maker cut its revenue estimates for the year-end quarter when it reported results late Tuesday. Intel'sstock?fell 56 cents to $21.79.

The Commerce Department said Wednesday that builders broke ground on building new single-family houses and apartments at the fastest pace since July 2008. Housing starts surged to an annual rate of 872,000 in September, far above estimates by economists.

"You might think it's a misprint," said Dan Greenhaus, chief global strategist at BTIG, in a note to clients. But over the past year, housing starts have climbed by 43 percent.

"If there was any doubt that the housing market was undergoing a recovery, even a modest one in the face of the terrible 2008 decline, those doubts should be erased by now," Greenhaus said.

In other trading, the Nasdaq composite index inched up 2.95 points to 3,104.12. More than two?stocks?rose for every one that fell on the New York?Stock?Exchange.

The housing report helped lift the yield on the 10-year Treasury note to 1.81 percent from 1.72 percent late Tuesday. Better economic news usually sends traders out of safe assets like Treasurys, and when bond prices fall their yields rise.

The 10-year Treasury yield, a standard benchmark for mortgages and other loans, started October at 1.63 percent.

Among other companies making big moves Wednesday:

? Dean Foods led all?stocks?in the S&P 500 with a 13 percent jump. The dairy company offered more details about its planned spin-off of a subsidiary, WhiteWave, the producer of Silk Soymilk. Dean Foods said it will keep at least 80 percent of WhiteWave after the company's initial public offering. The company's?stock?rose $1.92 to $16.96.

? The University of Phoenix's parent company, the Apollo Group, plunged 22 percent, the biggest drop in the S&P 500. A sharp drop in student enrollment has cut into profits, Apollo reported late Tuesday. To cope with shrinking enrollment, Apollo plans to close 115 of the university's mostly smaller locations. Its?stock?lost $6.09 to $21.40.

? Bank of New York Mellon surged $1.30 to $24.86 after reporting net income and revenue that topped analysts' estimates. The bank slashed expenses and collected more fees for managing investments. Investment income more than doubled from the year before.

Big tobacco says corrective statements go too far

WASHINGTON (AP) ? Tobacco companies are urging a federal judge to reject the government's proposed industry-financed corrective statements, calling them "forced public confessions."

The Justice Department countered that the statements need to be strong enough to protect people from future false statements made by cigarette makers. The statements include admissions that the companies lied about the dangers of smoking.

U.S. District Judge Gladys Kessler, who is hearing the case, has already said she wants the industry to pay for corrective statements in various types of ads. Although she has not made a decision on what the statements will say, she said at Monday's hearing that she doesn't have to take the government's proposed statements word-for-word, and will come up with "modifications."

In 2006, in a case the government brought in 1999 under the Racketeer Influenced and Corrupt Organizations, Kessler ruled that America's largest cigarette makers concealed the dangers of smoking for decades. The proposed statements by the cigarette-makers would become the remedy to ensure the companies don't repeat the violation.

In the 2006 ruling, which totaled more than 1,600 pages, Kessler wrote that the tobacco industry "survives, and profits, from selling a highly addictive product which causes diseases that lead to a staggering number of deaths per year, an immeasurable amount of human suffering and economic loss, and a profound burden on our national health care system."

The Justice Department's proposed statements would cover areas such as the addictiveness of nicotine, the lack of health benefit from "low tar," ''ultra-light" and "mild" cigarettes, and the negative health effects of second-hand smoke.

One example: "For decades, we denied that we controlled the level of nicotine delivered in cigarettes. Here's the truth: Cigarettes are a finely-tuned nicotine delivery device designed to addict people."

Noel Francisco, an attorney representing R.J. Reynolds Tobacco Co., one of the companies challenging the statements, said that they violate an appeals court decision which held that any corrective statements must be purely factual and uncontroversial. Francisco, who was speaking on behalf of several tobacco companies, including Philip Morris USA, the nation's largest tobacco maker, took issue with the "finely-tuned" statement.

"That's not an objective description of what a cigarette is," he said.

In July, a federal appeals court rejected efforts by the tobacco companies to overrule Kessler's ruling requiring corrective statements. The companies had argued that a 2009 law that gave the Food and Drug Administration authority over the industry eliminated "any reasonable likelihood" that they would commit future RICO violations.

So now the companies are trying to limit the scope of the statements, which they have said are designed to "shame and humiliate" them. They are arguing for factual statements that include the health effects and addictive qualities of smoking. Francisco argued that would be sufficient to prevent any fraud by the industry.

"It undermines our ability to do a flip-flop in the future," he said, adding that "confessional pejorative language is unnecessary."

But Justice Department lawyer Daniel K. Crane-Hirsch said that tobacco companies would "love" generic factual statements because it would not include the industry's record of deception.

"These companies don't want people to know what they have done ... They would like to erase history," he said.

"The purpose here is not to humiliate," he added, but to "inoculate" people against future false statements by the industry.
